Welcome to Especialisto.com.

These Terms of Service govern your use of Especialisto.com and its related services.

By accessing or using the Platform, you agree to these Terms. If you do not agree with them, you should not use the Platform.

1. About Especialisto.com

Especialisto.com is an online services marketplace that allows people and businesses seeking services (“Clients”) to discover and contact individuals or businesses offering services (“Providers”).

Especialisto provides the technology and online space that allows Clients and Providers to find and communicate with each other.

Especialisto does not itself provide the services advertised by Providers and does not become a party to any agreement made between a Client and a Provider.

Any service agreement, including the scope of work, price, payment method, timing and other conditions, is agreed directly between the Client and the Provider.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement in order to create an account or use features that require registration.

You agree to use the Platform in accordance with applicable laws and these Terms.

3. User Accounts

a. Registration

Some features of Especialisto require a registered account.

When creating an account, you must provide accurate and current information.

You are responsible for:

• Keeping your account information up to date
• Keeping your login credentials secure
• Activity carried out through your account

You must not create accounts using false identities or impersonate another person or business.

b. Account Restrictions and Suspension

Especialisto may restrict, suspend or terminate an account where we reasonably believe that:

• These Terms have been violated
• The account is being used fraudulently or unlawfully
• The user is harming or threatening other users
• Prohibited or misleading content has been published
• Continued access may create legal, security or operational risks

Where appropriate, we may contact the user regarding the reason for the restriction or suspension.

4. User Responsibilities

When using Especialisto, you agree to:

• Use the Platform only for lawful purposes
• Provide truthful and accurate information
• Avoid misleading, fraudulent or deceptive behaviour
• Respect other users
• Avoid impersonating another person or business
• Not publish illegal, abusive, discriminatory, threatening or harmful content
• Not upload content that infringes intellectual property, privacy or other legal rights
• Not use the Platform to distribute spam, malware or other harmful material
• Not attempt to interfere with the security or operation of the Platform

Service Providers are responsible for ensuring that the services they advertise and provide comply with any licences, qualifications, insurance, registrations or legal requirements applicable to their activity.

5. Service Listings and Provider Information

Providers are responsible for the accuracy of the information published in their profiles and service adverts.

Especialisto does not guarantee that information provided by a Provider is complete, accurate or up to date.

Unless explicitly stated otherwise, a Provider appearing on Especialisto should not be understood as being certified, licensed, insured, background-checked or professionally approved by Especialisto.

Clients are responsible for deciding whether a Provider is suitable for their needs and may request additional information directly from the Provider before entering into an agreement.

6. Direct Contact and Transactions

Clients and Providers communicate and make arrangements directly.

Especialisto does not:

• Negotiate service prices on behalf of users
• Collect a commission from transactions between Clients and Providers
• Control how a service is performed
• Guarantee payment by a Client
• Guarantee performance by a Provider
• Act as an agent for either party

Any payment for the actual service is arranged directly between the Client and the Provider unless Especialisto clearly introduces a specific Platform feature stating otherwise.

7. Platform Fees and Optional Paid Features

Creating an account and publishing a standard service profile is currently free.

Especialisto does not charge a commission on transactions between Clients and Providers.

We may introduce optional paid Platform features in the future, such as:

• Premium visibility
• Promoted listings
• Advertising
• Additional Platform features

Any price or recurring charge will be clearly displayed before the user purchases the feature.

Payments for paid Especialisto features may be processed by third-party payment processors such as Stripe.

Especialisto does not store full payment card details.

Any applicable refund rights for paid Platform features will be subject to the conditions presented at the time of purchase and any mandatory rights available under applicable consumer law.

8. Get Offer Requests

The “Get Offer” feature allows Clients to submit a service request through the Platform.

Relevant Providers may receive information from that request and may contact the Client directly.

Submitting a request does not create a contract with Especialisto or with any Provider.

A service agreement is created only when the Client and Provider separately agree to proceed.

Users must not include passwords, card details, identification documents or other unnecessary sensitive information in a service request.

9. Reviews and Feedback

Registered users may submit reviews and feedback in accordance with the Platform rules.

Reviews should:

• Be genuine
• Be based on the user's real experience
• Be relevant to the Provider or service
• Not contain unlawful, abusive, discriminatory, defamatory or threatening content
• Not contain unnecessary personal information
• Not contain spam or promotional content

Especialisto may remove or restrict access to reviews that violate these Terms or applicable law.

By submitting content to Especialisto, you grant us a non-exclusive, worldwide, royalty-free licence to display and technically reproduce that content to the extent necessary to operate and promote the Platform.

You retain ownership of your content.

10. User Content and Content Moderation

Users are responsible for the content they publish on Especialisto, including profiles, service adverts, photographs, reviews and other submitted information.

Especialisto may review, restrict, remove or disable access to content where we reasonably believe that it:

• Violates these Terms
• Is unlawful
• Infringes the rights of another person
• Is fraudulent or misleading
• Creates a safety or security risk
• Is spam or otherwise misuses the Platform

Content moderation may include manual review by the Especialisto administration and technical tools used to operate or protect the Platform.

11. Disputes Between Clients and Providers

Especialisto is not a party to service agreements between Clients and Providers.

Users are responsible for resolving disagreements relating to:

• The quality of a service
• Payment
• Deadlines
• Damage
• Cancellations
• Refunds relating to the Provider’s service
• Other terms agreed directly between the Client and Provider

Especialisto may choose to provide administrative assistance but is not required to mediate, decide or enforce private agreements between users.

Nothing in this section limits any rights a user may have under applicable law.

12. Intellectual Property

The Especialisto website, software, branding, design and original content are owned by or licensed to the operator of Especialisto.com and may be protected by intellectual property laws.

You may not copy, reproduce, modify, distribute or commercially exploit Especialisto content or branding without permission, except where permitted by law.

Users retain ownership of content they upload to the Platform, subject to the limited licence described in these Terms.

13. Third-Party Services and Links

Especialisto may contain links to or integrations with third-party websites and services.

Third parties operate independently and may have their own terms, privacy policies and practices.

Especialisto is not responsible for third-party websites or services that we do not control.

14. Platform Availability

We aim to keep Especialisto available and operating reliably, but we cannot guarantee uninterrupted or error-free access.

We may temporarily restrict or suspend access where reasonably necessary for:

• Maintenance
• Security
• Technical problems
• Updates
• Legal or regulatory reasons

We may also modify or discontinue Platform features.

Where appropriate, we will try to minimise disruption.

15. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Especialisto is not responsible for the performance, quality or outcome of services independently agreed between Clients and Providers.

To the extent permitted by applicable law, Especialisto is not liable for losses caused by:

• Information supplied by other users
• Agreements made directly between users
• Actions or omissions of Clients or Providers
• Third-party websites or services
• Events outside our reasonable control

These Terms do not limit any mandatory rights available to consumers under applicable law.

16. Account Termination

You may stop using Especialisto at any time.

You may request deletion of your account by contacting:

Especialisto may restrict, suspend or terminate an account where permitted under these Terms and applicable law.

Certain information may need to be retained after account closure where required for legal, security, fraud-prevention or legitimate record-keeping purposes, as further explained in our Privacy Policy.

17. Changes to the Platform and These Terms

We may update these Terms to reflect:

• Changes to the Platform
• New features
• Changes to applicable law
• Security or operational requirements

Where a change is significant, we will take reasonable steps to inform affected users.

The date at the top of these Terms will indicate when they were last updated.

18. Governing Law

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply in the country where a consumer normally resides.

Nothing in these Terms is intended to deprive a consumer of rights that cannot lawfully be excluded or limited.

19. Dispute Resolution and Courts

We encourage users to contact us first if they have a complaint relating to Especialisto.

Where a dispute cannot be resolved informally, the competent courts and applicable jurisdiction will be determined in accordance with applicable law.

These Terms do not require a consumer to give up any right to bring a claim before a court that has jurisdiction under mandatory consumer protection rules.
